These terms govern your use of Baya, a WhatsApp-based assistant that helps real estate brokers organise rental listings and tenant requirements. Baya is run by a sole proprietorship registered in Bengaluru, Karnataka, India (Udyam registration UDYAM-KR-03-0776026). By using Baya, you agree to these terms and to our privacy policy.

What Baya does

Baya reads the listings and requirements you send it on WhatsApp, organises them, lets you search them, and sends you alerts such as matches and availability checks. Baya is a tool for your own work. It is not a real estate broker, agent or party to any rental agreement, and it does not verify properties, owners or tenants.

Who can use Baya

• You must be at least 18 years old and able to enter into a binding contract.
• You must use Baya for lawful business purposes, mainly as a real estate broker or agent.
• You are responsible for activity on your WhatsApp number and for keeping your phone secure.

Your content

You keep ownership of the listings, photos, requirements and other content you send to Baya. You give us permission to store, process and display that content to you as needed to provide and improve Baya.

When you send content to Baya, you confirm that:

• You obtained it lawfully in the course of your work and are allowed to share it with a service that helps you manage it.
• It does not infringe anyone's rights or break any law.
• You will handle any personal details of owners and tenants that Baya returns to you responsibly and in line with applicable law.

Acceptable use

You agree not to:

• Use Baya to send spam, unsolicited bulk messages or misleading listings.
• Upload unlawful, abusive or harmful content.
• Try to access other users' data, disrupt the service, or reverse engineer it.
• Use automated tools to send messages to Baya at volumes beyond normal use.
• Use Baya in a way that breaks WhatsApp's terms or policies.

Accuracy

Baya uses automated systems, including AI, to read messages, photos and voice notes. It may sometimes misread details such as rent, deposit, location or tenant rules. Always check important details before sharing them with a client or making a decision. Baya does not guarantee that a listing is accurate, current or still available.

Fees

Baya may be free during early access. Paid plans, if any, will be shown to you before you are charged. Fees are payable in advance for the period shown and are non-refundable except where required by law or stated otherwise at the time of purchase. Prices may change with at least 15 days' notice.

Availability and changes

We work to keep Baya available but cannot promise it will always be uninterrupted or error-free. Baya depends on third-party services such as WhatsApp, which may change or become unavailable. We may add, change or remove features over time.

Suspension and ending your use

You can stop using Baya at any time and ask us to delete your data as described in our privacy policy. We may suspend or end your access if you break these terms, if your use creates risk for Baya or others, or if we are required to by law or by WhatsApp's policies.

Limitation of liability

To the extent permitted by law, Baya is provided "as is". We are not liable for indirect or consequential losses, including lost deals, lost commissions, lost profits or lost data. Our total liability to you for any claim related to Baya is limited to the amount you paid us in the three months before the claim, or ₹1,000 if you have not paid us.

You agree to be responsible for claims arising from the content you send to Baya or from your breach of these terms.

Governing law

These terms are governed by the laws of India. Courts in Bengaluru, Karnataka have exclusive jurisdiction over any dispute related to Baya, subject to any rights you have under consumer protection law.

Changes to these terms

We may update these terms. We will update the date at the top, and for significant changes we will notify you on WhatsApp or by email before they take effect. Continuing to use Baya after that means you accept the updated terms.
